Welcome to Atlas Palm Hatchery. By visiting our website, placing an order, joining a waitlist, reserving poultry, or purchasing products from Atlas Palm Hatchery, you agree to these Terms & Conditions and all applicable policies posted on our website.
Poultry Are Living Animals
Purchasing live poultry and hatching eggs involves risks that do not exist with ordinary retail products. Genetics, fertility, hatchability, development, temperament, sex, appearance, and survival can be influenced by biological and environmental factors outside our control.
By purchasing from Atlas Palm Hatchery, you acknowledge these inherent risks.
Product Descriptions
We make every reasonable effort to accurately describe breeds, varieties, generations, breeding projects, expected traits, and other characteristics.
Unless specifically stated otherwise, photographs are representative and do not guarantee that a chick will mature to look exactly like the bird pictured.
Color, pattern, crest development, feather type, body type, egg color, temperament, and other characteristics may vary, particularly in developing breeding projects or mixed/project lines.
Straight-Run Poultry
Unless expressly advertised otherwise, chicks are sold straight run.
Straight run means chicks have not been intentionally selected or guaranteed by sex. Purchasing multiple chicks does not guarantee an equal number of males and females.

Hatching Eggs
Hatching eggs are sold as fertile eggs from actively maintained breeding groups unless otherwise stated.
We do not guarantee hatch rates because incubation practices, shipping conditions, temperature fluctuations, handling, equipment accuracy, and other factors are outside our control after eggs leave our possession.

Availability & Hatch Dates
Poultry reproduction cannot be perfectly scheduled.
Listed hatch dates, availability dates, and quantities are estimates unless specifically stated otherwise. Fertility changes, failed hatches, weather, flock health, laying patterns, equipment issues, and other circumstances may affect availability.
Animal welfare always takes priority over fulfilling an order on a particular date.
If we cannot fulfill an order, we will contact the customer with available options, which may include transferring the order to another hatch date, store credit, substitution with customer approval, or a refund for the unavailable portion.
Pricing & Payment
Prices may change without notice. The price shown when an order is completed generally applies to that transaction unless there is an obvious pricing or technical error.
Orders are not considered confirmed until required payment has been successfully received.
Order Acceptance
Atlas Palm Hatchery reserves the right to decline or cancel an order when necessary, including because of inventory errors, hatch failures, animal welfare concerns, regulatory restrictions, suspected fraud, website errors, or circumstances that make safe fulfillment impossible.
If Atlas Palm Hatchery cancels an order that has already been paid, the affected amount will be refunded unless the customer chooses another available option.
Customer Responsibilities
Customers are responsible for ensuring that they may legally possess the poultry they purchase.
This includes checking applicable HOA rules, deed restrictions, city or county ordinances, zoning requirements, rooster restrictions, flock limits, permits, and other local regulations.
Atlas Palm Hatchery is not responsible if a customer's local rules prohibit keeping poultry after an order has been placed or fulfilled.
Animal Welfare
We reserve the right to refuse or cancel a sale when we reasonably believe fulfillment would place an animal's welfare at significant risk.
Shipping & Pickup
Shipping and pickup orders are governed by our separate Shipping Policy and Pickup Policy.
Live poultry will only be shipped when legally permitted and when appropriate transportation, weather, age, packaging, and regulatory requirements can be met.
Refunds & Cancellations
Refund and cancellation eligibility is governed by our Cancellation & Refund Policy and any product-specific policy applicable to the purchase.
Website Information
We make reasonable efforts to maintain accurate website information but cannot guarantee that every description, price, availability date, photograph, or other website element will always be error-free.
We reserve the right to correct errors when discovered.
Limitation of Liability
To the fullest extent permitted by applicable law, Atlas Palm Hatchery is not responsible for indirect or consequential losses arising from poultry ownership, unsuccessful incubation, breeding outcomes, local regulatory restrictions, or circumstances outside our reasonable control.
Nothing in these Terms limits rights or remedies that cannot legally be waived under applicable law.
Policy Changes
These Terms and our related policies may be updated as our hatchery grows, regulations change, or our services change.
The version displayed on the website at the time of purchase will govern that purchase unless applicable law requires otherwise.
